Hair Transplant Injury Compensation Claims

Baldness Treatment Injury

The issue of male baldness has hit the headlines recently, with TV chef Gordon Ramsay and Irish actor James Nesbitt both undergoing costly hair transplant surgery. With a recent British Medical Journal report showing that British males are now equally concerned about their appearance as females, there is an intense focus on ways of combating hair loss, which affects around 60% of men before the age of 40. A hair transplant involves extracting and moving healthy follicles from one 'donor' area of the head and implanting them in a 'recipient' bald or balding area.

The latest hair transplant techniques are constantly evolving and are increasingly successful, though the price of up to £30,000 means hair transplant surgery is only accessible to an affluent minority. Hair transplantation however offers no guarantees of success, and the industry as a whole has recently been termed the 'wild west of medicine' by the New York Times. There are also various dangers involved, and the unregulated nature of cosmetic treatments in the UK makes the choice of surgeon highly important for the prospective customer.

Compensation For Scalp Expansion Procedure Gone Wrong

A botched hair transplant may cause both physical and emotional damage, as well involving spiralling financial costs for corrective surgery. The process of extracting healthy follicles may leave a patient with permanent scarring if performed by an inexperienced or unqualified surgeon, and these scars will become increasingly noticeable as the hair continues to thin. Scarring will be particularly bad if the incisions in the scalp become infected, emphasising the importance of hygiene at clinics and the use of sterilised surgical implements. Poorly performed surgery may also result in trauma to the scalp which can lead to both the implanted hair and the remaining original hair falling out. Physical trauma and damage to nerves in the scalp may also lead to loss of sensation in both the donor and recipient sites. Hair transplant surgery is conducted under local anaesthetic, and clinics must ensure that medical background checks have been carried out to prevent the risk of an allergic reaction. It is also essential that anaesthetics such as lidocane are administered in the correct dosages.

Legal Responsibilities of Hair Transplant Clinics to Clients

Despite the increased sophistication of hair transplantation techniques, it remains an inexact science, and one that depends heavily on the skill of the individual surgeon. It is estimated that between a third and a half of patients attending hair transplant clinics are there for corrective surgery following previous botched efforts. As with other cosmetic surgical procedures, poorly carried out work can result in permanent disfigurement, physical pain and emotional trauma. Competition between cosmetic clinics often means that customers are lured in by misleading advertising and false claims. Patients may also be given unrealistic expectations as to what surgery will achieve. One unscrupulous tactic is for clinics to price hair transplant procedures artificially low in full knowledge that the customer will end up paying a lot more in the long run. Despite the lack of regulation of cosmetic clinics and surgeons, patients have a right to expect that their surgery will be performed in a reasonably competent and skillful manner. Anything less will be classified as clinical negligence.
